1. Acceptance of Terms

By accessing or using the FLEAP FLAPP platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our Service.

These Terms govern your access to and use of our services, including all content, functionality, and features available through our platform.

2. Description of Service

FLEAP FLAPP is a social platform that connects the global Haitian community through videos, live streaming, and cultural celebration. The Service may evolve over time as we add or remove features.

Our platform provides:

• Video sharing and streaming capabilities
• Community building tools
• Cultural content and events
• User-generated content sharing

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Be responsible for all activity that occurs under your account
• Not create accounts for others without their express permission
• Not create more than one personal account

4. User Conduct

You agree not to use the Service to:

• Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Harm minors in any way or solicit personal information from anyone under 18
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights
• Upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," or any other form of solicitation
• Upload, post, or transmit any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware

5. Content Ownership

You retain ownership of any content you post to FLEAP FLAPP. By posting content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Service.

You represent and warrant that: (i) you own the content posted by you on or through the Service or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and protect your personal information.

By using the Service, you consent to the collection and use of your personal information as outlined in our Privacy Policy.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

FLEAP FLAPP, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

9. Limitation of Liability

In no event shall FLEAP FLAPP, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
